* Constitution drafted by Ferby (Management) on the 31st of May, 2015 * Constitution to come into power on the 17th of June, 2015 * (First Amendment)[http://gravityforum.net/single/?p=8062725&t=7999848] made on the 15th of July, 2015 ► PREAMBLE We the people of Gravity Forum, to ensure our democratic process is protected and preserved, to give the voice of leadership and decision to the Community, and to protect ourselves from those with malicious intent, hereby establish this here Constitution in faith of Liberty and Democracy. ► ARTICLE ONE: Democratic Process # SECTION 1: All leadership and directorial powers that are not protected by the Constitution are hereby granted to a democratically named leader of Gravity Forum (herein known as the Named Director). # SECTION 2: The Administrative Team (also referred to as Administration) is composed of the Named Director and the three (3) registered accounts recognised by the Administrative Team as Staff. Two (2) of the three (3) Staff positions are protected by the democratic process to be positions filled by the Community. No registered account may hold the position of Named Director if they are not officially recognised as a Member of the Community (refer to ARTICLE 5.1) or has not reached the age of thirteen (13) unless no candidates are on the ballot when the voting process (refer to ARTICLE 1.5) begins. The Powers of the Administrative Team is that of the Named Director's executive decision. # SECTION 3: The Administrative Team may be in directorial power for a maximum of four (4) calendar months herein known as a Term before it is obligated to start the voting process (refer to ARTICLE 1.5). The voting process shall be carried out by the Named Director or if this is not possible for whatever reason, a registered account of that recognised by Administration as being one of a senior position. # SECTION 4: The campaigning process may begin on the third month of the democratic Term. In this month before voting begins any registered account who is eligible may campaign for any recognised position in the Administrative Team. In order to be recognised as a Candidate for the position they must post a Candidacy Announcement with the written format established by the Administrative Team in Gravity Hall with the title: [USERNAME]: Named Directorial Candidate. # SECTION 5: The voting process (refer to ARTICLE 1.5) begins on the day before the end of the democratic Term. Registered accounts will have two (2) days to cast their vote(s) (refer to ARTICLE 1.6) using the method officially recognised by the Administrative Team. On the day after voting closes the Owner defined by this here Constitution (refer to ARTICLE 1.9) will independently count and confirm verification of all submitted Votes, and will deliver the results discretely to the Administrative Team where they can use their chosen method of announcing the results and providing evidence of the counting and verification process to the Community. # SECTION 6: Each registered account has the right to cast their vote(s) using the officially recognised method by the Administrative Team using the Single Transferable Vote System to ensure accurate representative of the Community. In the case of only one candidate being on the ballot the Voting System will change to the First Past The Post system. The candidate will require fifty (50) percent of the Yes/No Vote in order to win. In the case of no candidates being on the ballot it will be the responsibility of the Community to encourage a registered account to campaign. In the failure to do so it will be decided that the Owner defined by this here Constitution (refer to ARTICLE 1.9) will hold the Named Director position until a registered account announces their candidacy for the Ballot and a vote is held to officially grant that account Named Directorial status. # SECTION 7: User groups will be of purpose to organise the Community into the necessary groups needed for development and the democratic process only. # SECTION 8: The Named Director holds the right to assign a registered account to fill the position of the third (3rd) Staff position in the Administrative Team. # SECTION 9: The account belonging to Scott Cummins under the user identification number 3345776 holds all ownership powers and holds the right to bypass Constitutional law, and will henceforth be known as the Owner of Gravity Forum. ► ARTICLE TWO: User Rights # SECTION 1: Each registered account belongs solely to its user. No registered account may hold more than one (1) user unless given approval by the Administrative Team. # SECTION 2: All written content in the form of pure text remains ownership of the Administrative Team unless it is of creative or programming purpose. This includes but is not limited to stories, poems, role-plays, programs, codes, and scripts. # SECTION 3: Each registered account will have access to personal messaging (also referred to as PM) abilities, and holds the right to presume that all messages sent will be kept private from the eyes of the public unless consent is granted by the sender. # SECTION 4: Each registered account must have reached a warning level of five (5) prior to a permanent ban (refer to ARTICLE 3.1) unless such registered account is used with intent to advertise and/or promote a third party. # SECTION 5: Each registered account holds the right to use their signature as a spot to advertise and/or promote a third party if such an account is used to contribute to the Community. # SECTION 6: Each registered account holds the right to opt-out of Gravity-wide emails (refer to ARTICLE 3.5). # SECTION 7: An amendment to the Constitution may be proposed by any Member of the Community (refer to ARTICLE 6.1) in Gravity Hall using the correct method and process laid out by this here Constitution and the Administrative Team. # SECTION 8: Each registered account holds the right to vote and contribute in the democratic process (refer to ARTICLE 1). ► ARTICLE THREE: Administrative Team Rights # SECTION 1: The Administrative Team holds the right to terminate a registered account if such an account has reached a warning level of five (5). Notification prior to the termination must be done unless such an account is used with intent to advertise and/or promote a third party (refer to ARTICLE 2.4). Termination of an account must either be in the form of placing a permanent ban on the account, or permanent removal or deletion of the account. Account terminations strips the account holder of all Constitutional Rights. # SECTION 2: The Administrative Team holds the right to lay and enforce the set of rules herein known as the Board Rules. # SECTION 3: Each Member of the Administrative Team will have access to a section with purpose of being exclusive to Administrative Team Members only. # SECTION 4: Each Member of the Administrative Team that is not of the Named Director position holds the right to take a Leave Of Absence for an agreed amount of time whenever they feel it needed. # SECTION 5: The Administrative Team may send a Gravity-wide email blast prior approval of the Named Director. The email blast must be of reasonable purpose as decided by the Administrative Team. # SECTION 6: The Named Director holds the right to modify any documentation on Gravity produced by a previous or current Administrative Team Member. # SECTION 7: The Administrative Team holds the right to lay and enforce the set of rules of the Administrative Team. ► ARTICLE FOUR: Administrative Team Standards and Rules # SECTION 1: Administration Members must respect and not question other Administration Members when in-sight of the Community. # SECTION 2: Each Administrative Team Member speaks on behalf of the Administrative Team and must not state anything which may damage the reputation or image of the Administrative Team. # SECTION 3: No Member of the Administrative Team may release confidential or private information held by Administration unless approved prior by the Named Director unless they hold such power granted by the Named Director. # SECTION 4: The Named Director holds the right to issue a dismissal if a Member of the Administrative Team a) Constantly displays inappropriate or unprofessional behaviour b) Uses their abilities and/or powers to an extent deemed prohibited c) Continuously break Administrative or Board Rules d) Disrespects other Members of Administration beyond what is permitted e) Violates the Constitution beyond what is considered unharmful to the Community ► ARTICLE FIVE: Community Experience and Advancement # SECTION 1: Each registered account may be recognised as a Member of the Community if that account actively participates in discussion, has made several friends/connections on Gravity, has a forum avatar and signature, shows a general interest in the Community and its advancement, actively takes interest in the democratic process, and been active within the Community in a large time frame, although not all of these are required. # SECTION 2: In order for a registered account to be officially recognised as a Member of the Community they must meet all requirements in ARTICLE 5.1 prior to completing the process necessary (refer to ARTICLE 5.3) for Membership laid out by the Administrative Team. A Member may lose their Membership if they no longer meet the requirements of ARTICLE 5.1, at which time Membership privileges will be taken from the account holder. # SECTION 3: The Administrative Team may lay out the process necessary for recognition of Membership of the Community. The process must actively allow the Community to comment on the Membership request of an individual in order for any concerns or feedback to be made known. Members of the Community and registered accounts must be kept within the same user group. # SECTION 4: Each Member of the Community holds the privilege of ownership of an emoticon which cannot be changed regularly or on-demand by said Member, cannot be no larger than 35 by 35 pixels, and have an emoticon code of that of a name they personally recognise. This includes their username, real name, or nickname. This image will be used throughout Gravity Forum when their username (defined in a program) is visible, this includes - but not limited to - their username, mention(ed/s) in a post and their username in the form of a user icon. # SECTION 5: Advertisements and promotions related to the advancement of Gravity Forum must be made with the approval of the Administrative Team. # SECTION 6: Each registered account may use the Gravity Forum currency herein known as Credits to purchase extra items for their profile over time with development (refer to ARTICLE 5.7) and holds the right of a full refund if the item they have purchased with Credits is that not as advertised or was not received in the agreed upon time-frame by both parties. # SECTION 7: Any developmental changes to Gravity Forum will be made known in some publicly accessible form by the Administrative Team. ► ARTICLE SIX: Constitutional Protection # SECTION 1: Amendments to this here Constitution requires approval by the Community in the form of a three (3) day poll vote in a thread entitled "[CHANGE] Amendment" in Gravity Hall using the format recognised by the Administrative Team. # SECTION 2: The Administrative Team must allow account holders time in the form of a few days to adapt to the any new Constitutional Amendments unless the Amendment was that of a minor one. # SECTION 3: All amendments to the Constitution must presented in a clear 'before and after' format for ease of reading when the amendment is established. # SECTION 4: It is the responsibility of those of the Community and those in a position of power to ensure that the Constitution is abided by the Community and the Administrative Team. Suspected failure to abide by the Constitution will result in an investigation by the Owner defined by this here Constitution (refer to ARTICLE 1.9). It will be to the discretion of those who are investigating to how the process is completed but the process must be presented amongst the findings of the investigation. ► ARTICLE SEVEN: Developmental Progression # SECTION 1: All program content in the form of any coding language belongs the property of administration unless such code is of a third party source. It is the duty of administration to keep all codes working as intended. # SECTION 2: Administration may hire a maximum of two (2) developers to ensure developmental progress is made. A developer will be known as a Member of the Administrative Team. This holds the developers legally binding that progress will be made and administration will be thoroughly informed of developmental progress throughout. If no development positions have been filled it will be the duty of the Named Director to decide the developmental state of Gravity Forum. # SECTION 3: Developers hold the administrative power to make developmental changes to Gravity without prior approval of the Administrative Team, however the Named Director holds the right to order the removal of any program content unless protected by this here Constitution.
